01The agreement
These Terms of Service (the “Terms”) are an agreement between you — the community or organisation using Givana — and Givana. By creating an account or using the service, you agree to these Terms and to our Privacy Policy.
If you are accepting on behalf of an organisation, you confirm you have authority to bind that organisation.
02Accounts & eligibility
You must be at least 18 and able to enter a binding agreement. You're responsible for keeping your credentials secure and for activity under your account. Invite teammates with the appropriate role, and remove access promptly when it's no longer needed.
Tell us promptly if you suspect any unauthorised access to your account.
03The service we provide
Givana provides software to create giving pages, accept gifts through a connected payment processor, issue receipts, and keep reconciled records. We provide the experience and the records; we do not take custody of your funds.
Features may change over time as we improve the product. We won't materially reduce core functionality you rely on without reasonable notice.
04Payments, payouts & fees
Gifts are charged and settled by our payment processor into your community's own connected account. Processor fees are set by the processor; Givana's platform fee is shown transparently on our Pricing page.
- You authorise Givana to facilitate charges, payouts, and refunds on your instruction.
- You're responsible for any taxes applicable to gifts received.
- Refunds follow our Refund Policy.
05Your responsibilities
You agree to use Givana lawfully and to provide accurate information about your organisation. You're responsible for the content of your giving pages, the accuracy of fund descriptions, and the receipts you issue to donors.
You'll comply with the rules of the payment processor and with applicable financial, tax, and charity regulations in your jurisdiction.
06Acceptable use
To protect everyone, you agree not to use Givana to:
- Solicit funds fraudulently or misrepresent how gifts will be used.
- Process payments unrelated to genuine charitable or community giving.
- Attempt to breach security, probe for vulnerabilities, or disrupt the service.
- Upload unlawful, infringing, or harmful content.

07Data & ownership
Your data stays yours. You can export your donations, donors, and statements at any time, and we won't hold your records hostage. We handle data as described in the Privacy Policy.
08Availability & support
We work hard to keep Givana available and reconciled, but we don't promise the service will be uninterrupted or error-free. We'll provide support through the channels described on our site and aim to respond promptly to urgent issues.
09Suspension & termination
You may close your account at any time. We may suspend or terminate access where these Terms are breached, where required by our processor or the law, or to protect the safety of the service — giving reasonable notice where we can.
On termination you may export your data for a reasonable period, after which it is handled per our retention practices.
10Disclaimers
Except as expressly stated, the service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the service will meet every requirement or be free of all errors.
11Limitation of liability
To the fullest extent permitted by law, Givana will not be liable for indirect, incidental, or consequential losses. Our total liability for any claim is limited as set out in this section. Nothing here limits liability that cannot be limited by law.
12Changes to these terms
We may update these Terms as the service evolves. We'll update the version and date above and, for material changes, notify communities in the dashboard or by email before they take effect. Continuing to use Givana after changes means you accept them.
13Governing law
These Terms are governed by the laws of the jurisdiction stated in your service agreement [placeholder]. Disputes will be handled in the courts of that jurisdiction, unless applicable law requires otherwise.
